People vs. Prieto, 80 Phil 138 (1948) Digest

3
Treason (Two-witness Rule)
People vs. Prieto, 80 Phil 138 (1948)

Facts:
Eduardo Prieto was prosecuted for 7 counts of Treason in which he entered a plea of guilty to counts 1, 2, 3 and 7.  The prosecution introduced two witnesses who gave evidence on count 4 but their statements do not coincide on any single detail.

Issue:
Whether or not Eduardo Prieto is guilty of the crime of treason (based on count 4)

Held:
            No.

Ratio:

This evidence does not satisfy the two-witness principle. The two witnesses failed to corroborate each other not only on the whole overt act but on any part of it.
